Terms of Service

1. About us

ReadyStack Digital ("we", "us", "our") is a Sydney-based provider of websites, hosting, Microsoft 365 setup, email security, Essential Eight alignment, monthly managed care, and AI agents and automations for Australian businesses.

2. Our services and quotes

Any prices shown on this website or given by our AI assistant are indicative "from" prices to help you plan. They are not a binding quote. The final scope, deliverables, timeline and price for your project are set out in a written proposal or service agreement, which prevails over anything on this website if there is any inconsistency.

3. Payments

Fees, payment schedules and any deposits are as set out in your proposal, agreement or invoices. Ongoing services such as monthly care are billed on a recurring basis and continue until cancelled in line with your agreement.

4. Your responsibilities

5. Intellectual property

Subject to full payment, you own the final website content and deliverables we create specifically for you. We retain ownership of our pre-existing tools, code libraries, templates and methods. Third-party components (such as fonts, plugins or platforms) remain subject to their own licences.

6. Third-party services

Our services may involve third parties such as domain registrars, hosting providers, Microsoft, Cloudflare, Cal.com and others. Your use of those services is also subject to their terms, and we are not responsible for outages or changes outside our control.

7. AI assistant

Our AI assistant ("Stack") provides general information about our services and may occasionally be inaccurate or incomplete. It does not provide professional, legal, financial or security advice, and its responses are not a binding offer or quote. For anything important, please confirm with our team. You must not misuse the assistant. See our Acceptable Use Policy.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot be lawfully excluded. Where permitted, our liability for a failure to meet a consumer guarantee is limited to re-supplying the relevant service or paying the cost of re-supply.

9. Disclaimers and liability

The website and AI assistant are provided "as is". To the extent permitted by law, and subject to your Australian Consumer Law rights, we are not liable for indirect or consequential loss arising from your use of this website or assistant. We don't guarantee the website or assistant will be uninterrupted or error-free.

10. Termination

You may stop using the website and assistant at any time. We may suspend or restrict access if these terms or our Acceptable Use Policy are breached. Termination of any paid service is governed by your service agreement.

11. Changes to these terms

We may update these terms from time to time. The current version will always be available on this page, with the "last updated" date shown above.

12. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

13. General

If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms, together with any service agreement we sign with you, set out the whole agreement between us about their subject matter.
